2. OBJET / PURPOSE

The present general terms and conditions of sale govern all sales of products offered on www.capitoltshirts.com. By placing an order, the customer acknowledges having read and accepted these terms without reservation.

3. PRODUITS ET PRIX / PRODUCTS AND PRICING

  • All products are described and presented with the greatest possible accuracy
  • Prices are indicated in Euros (EUR) and include all applicable taxes (VAT included)
  • Prices include French VAT but exclude shipping costs, which are calculated at checkout
  • We reserve the right to modify prices at any time, but orders will be invoiced based on the rates in effect at the time of order validation
  • Product images are not contractual and may differ slightly from actual products

4. COMMANDES / ORDERS

  • Orders can be placed online at www.capitoltshirts.com
  • Order confirmation is sent by email after payment validation
  • We reserve the right to refuse or cancel any order in case of dispute with a customer, non-payment of a previous order, or in case of suspected fraud
  • The sales contract is concluded upon our acceptance of your order

5. PAIEMENT / PAYMENT

  • Payment is due at the time of order
  • Accepted payment methods: credit/debit cards, PayPal, and other methods displayed at checkout
  • Payment is secure and processed through Shopify Payments
  • Orders are processed only after payment confirmation

6. LIVRAISON / DELIVERY

  • Products are shipped to the address provided by the customer
  • Delivery times:
    • France: 3-7 business days
    • European Union: 5-10 business days
    • International: 7-20 business days
  • Delivery times are estimates and may vary
  • Products may ship from different fulfillment locations and arrive in separate packages
  • Shipping costs are calculated at checkout based on destination and cart contents
  • Risk of loss transfers to the customer upon delivery
  • For international orders, customs duties and taxes may apply and are the customer's responsibility

7. DROIT DE RÉTRACTATION / RIGHT OF WITHDRAWAL

In accordance with Articles L221-18 et seq. of the French Consumer Code, you have a 14-day withdrawal period from receipt of your order.

How to exercise your right:

  • Send a clear written statement to contact@capitoltshirts.com within 14 days
  • Return products in their original condition, unused, with all tags attached
  • Return shipping costs are at the customer's expense unless the product is defective

Refund:

  • We will refund all payments received, including initial shipping costs (except additional costs if you chose expedited shipping)
  • Refund will be processed within 14 days of receiving the returned product
  • Refund will use the same payment method as the original purchase

Exceptions to withdrawal right:

  • Personalized or custom-made products
  • Products that cannot be returned for hygiene reasons if unsealed

8. GARANTIES / WARRANTIES

Legal Guarantee of Conformity (Articles L217-4 to L217-14 of the French Consumer Code):

  • You benefit from a 2-year legal guarantee from delivery
  • Products must conform to the description and possess the expected qualities
  • Defects existing at delivery are presumed to exist within 24 months (12 months for used goods)

Legal Guarantee Against Hidden Defects (Articles 1641 to 1649 of the Civil Code):

  • Protection against hidden defects rendering the product unfit for use
  • You may choose between refund or price reduction

9. RESPONSABILITÉ / LIABILITY

  • We are responsible for delivering products conforming to the order
  • Our liability is limited to direct damages and excludes indirect damages
  • We are not liable for delays or non-performance due to force majeure

10. PROPRIÉTÉ INTELLECTUELLE / INTELLECTUAL PROPERTY

  • All content on www.capitoltshirts.com (images, text, logos, designs) is protected by intellectual property rights
  • Any reproduction or use without authorization is prohibited
  • Product designs and graphics are protected by copyright

12. MÉDIATION / MEDIATION

In accordance with Articles L611-1 and R612-1 et seq. of the French Consumer Code, we offer a consumer mediation system. In accordance with French consumer law, we will designate a certified consumer mediator. Information will be updated shortly.

13. DROIT APPLICABLE ET JURIDICTION / APPLICABLE LAW AND JURISDICTION

  • These terms are governed by French law
  • In case of dispute, we encourage you to contact us first to seek an amicable solution
  • Failing an amicable resolution, French courts shall have exclusive jurisdiction
  • For consumers residing in the EU, you may also bring proceedings in the courts of your country of residence
